Status: October 2026§ 1 Scope of Application(1) These General Terms and Conditions (GTC) apply to all orders and contracts concluded via the online shop of solocca GmbH, Am Fischagraben 6, 2433 Margarethen am Moos, Austria (hereinafter referred to as the "Seller").(2) A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor attributable to their independent professional activity. An entrepreneur is any natural or legal person or legal partnership acting in the exercise of their commercial or independent professional activity when concluding a legal transaction.§ 2 Offer, Review, and Conclusion of Contract(1) The product descriptions in the online shop do not constitute a legally binding offer by the Seller, but rather an invitation to the customer to submit a binding offer (*invitatio ad offerendum*).(2) By submitting an order via the "Buy Now" button (or equivalent), the customer submits a binding offer to purchase the goods contained in the shopping cart.(3) The Seller will confirm receipt of the order without delay via email (Order Receipt Confirmation). This Order Receipt Confirmation does not constitute acceptance of the contractual offer, but merely informs the customer that the order has been received by the Seller.(4) The Seller reserves the right to manually review the order offer prior to acceptance. In particular, the availability of inventory as well as the legal and technical suitability of customer-uploaded content (e.g., custom photo prints for back panels) will be checked.(5) The purchase contract is only concluded when the Seller expressly accepts the customer's offer within 3 working days by:– sending a separate Order Confirmation via email, or– dispatching the goods to the customer.
(6) As part of the ordering process via the selected payment method (credit card, PayPal, etc.), the invoice amount is initially only authorized or reserved. The actual debiting of the invoice amount (capture) takes place only upon manual acceptance of the order and the conclusion of the contract (Order Confirmation). If the offer is not accepted or is rejected, the reservation will be canceled immediately.§ 3 Prices and Payment(1) All prices are quoted in Euros including statutory Austrian value-added tax (20%). Shipping costs are indicated separately in the shopping cart system and in the order summary prior to placing the order.(2) The payment methods specified in the online shop are available to the customer (e.g., credit card, PayPal).§ 4 Delivery and Delivery Times(1) We deliver to Austria, Germany, and other EU countries.(2) Order processing, inventory verification, and review of submitted print data (photo upload) take place within the acceptance period specified in § 2 (5).(3) The delivery time is 7–14 working days. The delivery period begins on the working day following the conclusion of the contract (§ 2 (5)) and successful payment authorization or approval of the print data.§ 5 Right of Withdrawal (Cancellation Right)(1) Consumers have a statutory right of withdrawal in distance selling contracts.(2) Exception to the Right of Withdrawal (Section 18 (1) Z 3 FAGG): The right of withdrawal does not apply to the supply of goods that are made to customer specifications or are clearly personalized. This applies in particular to individually printed back panels/components featuring a customer-submitted photo upload.(3) Detailed information regarding the right of withdrawal, its conditions, consequences, and a model withdrawal form can be found in our separate Cancellation Policy.(4) The Cancellation Policy will also be provided to the customer in durable medium form (PDF attachment) together with the order confirmation via email.§ 6 WarrantyStatutory warranty rights under Austrian law apply. The warranty period is two years from delivery of the goods.§ 7 Limitation of Liability(1) The Seller is liable without limitation for damages arising from injury to life, body, or health.(2) For other damages, the Seller is liable only in cases of intent and gross negligence. In cases of slight negligence, the Seller is liable only for breach of essential contractual obligations (cardinal obligations); in this case, liability is limited to foreseeable damages typical for the contract.(3) The provisions of the Product Liability Act (PHG) remain unaffected by the above provisions.§ 8 Applicable Law and Jurisdiction(1) Austrian law applies, excluding the conflict-of-law rules of private international law and the UN Sales Convention (CISG). For consumers, this choice of law applies only to the extent that protection granted by mandatory provisions of the law of the state in which the consumer has their habitual residence is not withdrawn.(2) The place of jurisdiction for all disputes arising from contracts with merchants or entrepreneurs is the court having subject-matter jurisdiction for the registered office of solocca GmbH (e.g., Regional Court Korneuburg / District Court Bruck an der Leitha). For consumers, statutory rules of jurisdiction under the Austrian Consumer Protection Act (KSchG) apply.§ 9 Dispute Resolution(1) The European Commission provides a platform for online dispute resolution (ODR), available at https://ec.europa.eu/consumers/odr.(2) We are neither obligated nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
